Judicial separation for discord under Jordanian law

Cases seeking judicial separation for discord are personal status matters heard by the Sharia courts in Jordan. Jordan’s Personal Status Law No. 15 of 2019 regulates these cases and their procedures when harm or serious conflict makes married life difficult to continue.

What is judicial separation for discord?

It is the ending of a marriage by court order where harm is alleged to make continued married life untenable. The alleged harm may be physical, such as abuse or assault, or non-physical, such as humiliation, mistreatment or failure to respect marital rights and duties.

Article 126 of Jordan’s Personal Status Law addresses judicial separation for discord and the procedures connected with a claim by either spouse.

Can a wife seek judicial separation for discord?

Yes. Jordanian law allows a wife to seek judicial separation for discord. If the judge verifies her allegation, the court first attempts to reconcile the spouses. If reconciliation is not possible, the judge warns the husband to improve the situation and adjourns the case for at least one month.

If reconciliation still fails and the wife maintains her claim, the judge refers the matter to two arbitrators to examine the reasons for the dispute, attempt reconciliation and assess each party’s responsibility for the continuation of the conflict.

What do the two arbitrators do?

The arbitrators are appointed to try to reconcile the spouses and examine the causes of the discord. They must be fair and capable of reconciliation. Where possible, one is from the husband’s family and the other from the wife’s; if that is not possible, the judge appoints two people with relevant experience, fairness and the ability to reconcile.

If reconciliation is not achieved, the arbitrators submit their report to the judge. The court then decides the case under the law and the facts established. Financial consequences may vary according to the circumstances and the court’s decision.

Who may have to pay compensation?

The result depends on the arbitrators’ assessment of each spouse’s responsibility for the discord. If all wrongdoing is attributed to the wife, they may order separation with compensation that does not exceed the mahr and its appurtenances. If all wrongdoing is attributed to the husband, they order separation by an irrevocable divorce, and the wife may claim any unpaid mahr and its appurtenances and maintenance for her waiting period.

If both spouses share responsibility, the compensation is apportioned according to their respective responsibility. If that proportion cannot be determined, the arbitrators set compensation payable by either spouse, not exceeding the mahr and its appurtenances. The responsible party and amount therefore cannot be determined without examining the case.

How long does a judicial separation case take?

The law provides for an adjournment of at least one month during the reconciliation stage described in Article 126, but that does not set the total duration of a case. The overall timeframe depends on the circumstances, court procedures, reconciliation efforts and the arbitrators’ work. It cannot be estimated without reviewing the case file.

Must the wife provide physical evidence of every allegation?

The law sets out ways to prove discord, conflict and harm. Article 127, read with Article 126(a), provides for testimony by two men or one man and two women, and allows testimony based on common knowledge within the spouses’ circle of life. The court assesses the material presented in light of the case.

Divorce and judicial separation for discord are different

Divorce and court-ordered separation are different legal routes for ending a marriage. Judicial separation for discord is pursued through the court under the procedures in the Personal Status Law. The applicable rules and procedures in other situations depend on the reason for ending the marriage and the facts of the case.

The law provides that a judgment for separation due to discord includes an irrevocable divorce. The effect of the judgment and related financial rights depend on the court’s decision in light of the case.
