A legal overview of the distinction between manufacturing, trafficking and promotion, and the penalties and aggravated circumstances under Jordan's drug law.

Which law governs drug offences in Jordan?

Narcotic Drugs and Psychotropic Substances Law No. 23 of 2016 and its amendments regulate conduct involving substances listed in the attached schedules, The law permits certain dealings for licensed medical or scientific purposes, The substance, schedule and relevant authorisation should therefore be checked before classifying conduct.

Official bodies update the substance schedules from time to time, and the Jordan Food and Drug Administration publishes law and schedule documents, Check the law and schedules in force at the relevant time rather than relying on an informal name or an outdated summary.

What is the difference between production and manufacture?

Article 2 distinguishes production, described as separating a narcotic or psychotropic substance from its plant source, from manufacture, which includes obtaining the substance through other methods, such as certain extraction, conversion or preparation processes, as defined by the statute.

People often use “manufacturing” broadly, but the legal classification depends on the statutory definitions, the substance and process, and whether the activity was authorised, A general description or fictional example cannot establish an offence or an individual's criminal responsibility.

What does Breaking Bad show about manufacture and trafficking?

The series follows Walter White, a chemistry teacher who enters the manufacture and sale of methamphetamine, Its fictional storyline illustrates a progression from making a drug to selling it.

Breaking Bad is a work of fiction set in the United States, not a source of Jordanian law, The series cannot determine how conduct is charged or punished in Jordan; that depends on Jordanian law, the facts and the evidence in each case.

When does Article 19 apply to trafficking?

Article 19(a) addresses specified conduct when committed with intent to traffic, The listed conduct includes bringing in, producing, manufacturing, smuggling, buying or selling a controlled substance, as well as possessing, transporting, storing, importing, exporting or otherwise dealing in it, with provisions concerning plants from which controlled substances are produced.

The intent stated in the provision is central to classifying the listed conduct, Finding or possessing a substance does not, by itself, automatically establish trafficking; the facts, evidence, each person's role and applicable provision must be assessed, Promotion has a separate statutory definition and penalties and is covered in another article on this site.

What are the basic and aggravated penalties?

Article 19(a) provides for temporary hard labour for not less than fifteen years and a fine of JOD 10,000 to 20,000 for conduct covered by that provision when committed with intent to traffic.

Article 19(b) provides for life hard labour and a fine of JOD 20,000 to 30,000 when specified statutory circumstances are established, These include repetition, certain duties related to combating drug offences or supervising controlled dealings, or committing the offence with or using a minor, The court applies the provision after reviewing the case file.

What applies to unauthorised dealings in chemical precursors?

The law defines chemical precursors as listed substances that can produce, enter into the manufacture of, or assist in producing narcotic drugs or psychotropic substances.

Article 17 penalises specified unauthorised dealings in these precursors, such as manufacturing, transporting, selling, possessing or storing them, when they are intended for use in manufacturing or producing controlled substances, The stated penalty is temporary hard labour for not less than fifteen years and a fine of JOD 10,000 to 30,000, This does not apply to every chemical; the schedule, conduct, intent and any authorisation must be checked.

Does Article 20 apply to every drug case?

No, Article 20 links the death penalty to specifically stated circumstances involving offences under Article 19, including circumstances connected with an international drug-trafficking gang or another international crime described in the provision.

The penalty does not automatically follow from every allegation of manufacture, possession or promotion, Calling a case “international” is not enough without establishing the statutory conditions, The full provision must be read against the facts established in each file.

What issues should be reviewed in a case?

The issues depend on the charge and facts, They may include technical identification of the substance and its schedule, the precise conduct alleged, the intent required by the provision, attribution of each act to each person, any authorisation, and the seizure, search and other evidence and procedures.

These are general review points, not a guarantee that a charge will be dismissed or that a particular result will follow, Do not delete messages or documents or publish investigation details and personal information online.

What should the accused person or family do?

Keep notices and decisions, record the case number, authority and current stage, and organise documents lawfully available to you, Ask a lawyer to review the file, explain the charge and applicable provisions, and discuss procedural options without withholding material facts.
